Data Protection Commission welcomes outcome of prosecution of marketing offences

This week, the Data Protection Commission (DPC) welcomed the outcome of prosecution proceedings taken in Cork District Court. The case was brought by the DPC against Sempiternal Aesthetics Limited t/a SISU Clinic.

Sempiternal Aesthetics Limited t/a SISU Clinic

At Cork District Court before Judge Carroll on 20 November 2024, Sempiternal Aesthetics Limited t/a SISU Clinic pleaded guilty to six charges of sending unsolicited marketing emails to a customer without consent and six charges relating to the failure to provide the customer with a valid address to opt out of receiving such communications.

The court applied the Probation Act to all twelve counts based on the fact the company had engaged with the DPC and rectified its systems to ensure that this issue will not happen in the future.

Sempiternal Aesthetics Limited t/a SISU Clinic was ordered to pay €500 towards the legal fees of the DPC.

Previous Warning

The DPC issued a warning previously to the defendant in June 2023. This followed the investigation of a complaint from a member of the public in relation to marketing emails and requests for opt-outs not being respected.
