Can the DPC get my personal data for me from an organisation?
This relates to an Article 15 subject access request.
No, the Data Protection Commission (DPC) cannot make an access request on your behalf. If an individual wishes to access a copy of their personal data, they must make that application themselves first to the data controller. If there is no response from the data controller or if the individual is dissatisfied with the response from the data controller, then the matter can progress to our complaint handling team who then engage with the data controller on your behalf.
It is possible, through our complaint-handling team, for the DPC to assist you in obtaining copies of your personal data from an organisation as long as there is no lawful restriction on accessing that personal data. If the personal data is going to be released, it is released directly to the individual data subject and it is not released to the DPC.
