Will I get any money if a data controller has infringed my data protection rights?
There is no mechanism for the Data Protection Commission (DPC) to award compensation so therefore you will never receive any money from the DPC after you submit a complaint even if a finding is made in your favour.
Some data controllers may decide to offer a goodwill gesture to a data subject but the DPC has no involvement in that and cannot request a data controller to consider it or increase any existing offer. Likewise, some data controllers, such as government agencies, are unable to offer any money as a goodwill gesture. It is up to each data subject, where they have been offered a goodwill gesture, to decide for themselves if they are happy to accept it. The DPC cannot provide any advice in relation to this as it is entirely between the data subject and the data controller. Any claims for compensation should be brought to the courts as per Article 82(6) of the GDPR.
